By accessing and using Aug's token creation platform (the "Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, you must not use this Service.

Aug provides a platform for creating and managing tokens on the Solana blockchain. The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind.

2. Limitation of Liability and Disclaimer

• Financial Losses: Any financial losses, damages, or losses of funds resulting from your use of the Service, including but not limited to lost tokens, lost private keys, failed transactions, smart contract bugs, or blockchain network issues.
• User Actions: Any actions you take using the Service, including creating tokens, transferring tokens, minting, burning, freezing accounts, or any other token operations.
• Legal Compliance: Your compliance with any applicable laws, regulations, securities laws, tax laws, or other legal requirements in your jurisdiction.
• Tax Obligations: Any tax liabilities, reporting requirements, or tax fraud that may result from your token creation or management activities.
• Regulatory Compliance: Compliance with securities regulations, KYC/AML requirements, or any other regulatory obligations.
• Token Value: The value, utility, or success of any tokens created using the Service.
• Third-Party Actions: Actions of third parties, including but not limited to wallet providers, exchanges, other token holders, or malicious actors.
• Technical Issues: Blockchain network failures, Solana network congestion, transaction failures, or any technical issues beyond our control.
• Security Breaches: Loss of private keys, wallet compromises, phishing attacks, or any security breaches.
• Fraudulent Use: Any fraudulent, illegal, or malicious use of tokens created through the Service.

YOU ACKNOWLEDGE AND AGREE THAT YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK AND THAT WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES.

By using the Service, you represent and warrant that:

• You are solely responsible for determining whether creating or managing tokens is legal in your jurisdiction.
• You will comply with all applicable laws, including securities laws, tax laws, and regulations.
• You are solely responsible for all tax obligations and reporting requirements related to your token activities.
• You will not use the Service for any illegal, fraudulent, or malicious purposes.
• You understand that token creation may be subject to securities regulations and you are responsible for compliance.
• You are responsible for securing your wallet, private keys, and all access credentials.
• You understand that blockchain transactions are irreversible and you are responsible for verifying all transaction details.
• You will not create tokens that infringe on intellectual property rights or violate any laws.

Aug does NOT provide tax advice, legal advice, or financial advice. You should consult with qualified tax professionals, legal counsel, and financial advisors regarding:

• Tax implications of creating tokens
• Securities law compliance
• Regulatory requirements in your jurisdiction
• Proper disclosure and reporting obligations
• KYC/AML compliance requirements

Aug is a technology platform that provides tools for interacting with the Solana blockchain. Aug is NOT:

• A financial institution
• A broker-dealer
• An investment advisor
• A money transmitter
• A custodian of funds or tokens
• A party to any token transactions

Aug does not hold, custody, or control any user funds or tokens. All transactions occur directly on the Solana blockchain.

7. Blockchain and Technology Risks

You acknowledge and accept the following risks:

• Irreversibility: Blockchain transactions are irreversible. Once executed, transactions cannot be undone.
• Network Risks: The Solana network may experience downtime, congestion, or failures beyond our control.
• Smart Contract Risks: Smart contracts may contain bugs, vulnerabilities, or unexpected behavior.
• Private Key Responsibility: Loss of private keys results in permanent loss of access to tokens.
• Regulatory Changes: Cryptocurrency regulations are evolving and may change at any time.
• Wallet Risks: Third-party wallet providers may have their own risks and limitations.

8. Prohibited Uses

You agree NOT to use the Service to:

• Create tokens for illegal purposes or fraudulent schemes
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Create securities without proper registration or exemptions
• Engage in market manipulation or pump-and-dump schemes
• Facilitate money laundering or terrorist financing
• Violate sanctions or embargo laws
• Impersonate others or misrepresent token properties

9. Indemnification

You agree to indemnify, defend, and hold harmless Aug, its operators, developers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

• Your use of the Service
• Your creation or management of tokens
• Your violation of these Terms
• Your violation of any laws or regulations
• Any claims by third parties related to your tokens
• Your failure to pay taxes or comply with tax obligations

10. No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of any information
• Warranties that tokens created will have any particular value or utility

11. Modifications to Terms

Aug reserves the right to modify these Terms at any time. We will notify users of any material changes. Your continued use of the Service after changes constitute acceptance of the modified Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or use of the Service shall be resolved through binding arbitration, except where prohibited by law.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
